I bought my home back in 2006 and closed in January 2007. A few weeks prior to my foreclosure, my son who lives with me was hit by a drunk driver and totaled my vehicle. I am a real estate broker and my income has dropped drastically. I have borrowed money from the equity in my home but is is running out. I have had several health issues that have continued to cause a problem since we bought our home three years ago. These have caused increased bills, loss of income, etc. We can’t seem to get anyone from Countrywide to call back I wanted to try and workout some kind of mortgage adjustment or refince but we had to file for a Chapter 13 in November of 2006 so they won’t even consider it. Our rate has jumped from 7.4 to 12% and is set to jump again this month. Our original note was $1147.00 but has jumped to $1749. There is no way we can afford this. If they would take the notes we are behind and place them at the end of our loan and place us back at a fixed 7.4% we could manage. Can you help? I guess the best thing to do may be to just sell but we have (3) houses for sell in our small 14 home subdivision and nothing is moving. I am willing to do whatever you suggest. Wife was pregnant when we purchased the home. because of difficulties, she was off work for almost five months. we have been trying to catch up ever since, but keep getting farther behind. GMAC Mortgage Company is foreclosing. We are now behind 3 months due to them not accepting any payments after we got 1 month behind. We had fell behind when my husband lost his job right before Christmas because he reported his boss to the corporate office for wrong doings. We were still paying the mortgage as well as we could and caught back up completely by March or so. He did get another job in March. This is why they are doing this but we just need someone or something to cut us a break. We have been overwhelmed with problems lately.
Then the real trouble started in June-July. We had several repairs to do on my car to keep it running and several on his truck, some were major parts. We also had to replace a hot water heater, 2 dripping facets, a hose to the washing machine, fix the air conditioner and the floor under the water heater and laundry room because of the water damage. We are trying to get the insurance company to pay us back for some of this and it looks like we need a new one. It was like one thing every week for the last two or three months which kept us from having that whole payment to send. We felt like what else could go wrong and then we talked to the mortgage company about giving them one payment then the other the next week and they asked us to write a hardship letter and we did. We called to check the status of that and they said it would be a few weeks before someone could read it and our account had been sent to foreclosure for review or something. Now they say keep our money and they will let us know. We are accruing so many fees right now that there will be no way we can pay them even if we save our monthly payment. My husband has gotten an even better job now making more money and some over time. One of our kid is out of daycare now so that saves us a lot of money and thru all of our problems we managed to pay off our truck when we caught up on the mortgage this year, so no more payment for that. We make enough to pay our bills and believe we can keep up the payment from here on out, if they will just work with us to get caught up, for good. We need loan modification help

In September Option One Mortgage returned our payment, with no reason why. When I contacted them as to why they stated that they we going to foreclose on the loan. Stating that we were 5 months behind. This I know is not true, we were 1 month behind I admit and were trying to get caught up. We had been trying to work with the mitigation team but were getting the run around. We need Option One foreclosure help. Once we thought all hope was lost we found a company on the internet that promised to help us. This home has been in my family for over 50 years and I do not want to loose it. I have tried to work with them but they don’t return my calls, or anything. When we originally got the mortgage we were told our payments would be one amount but at closing we learned that they were to be at least $200 more. Oct 2007 it went into pre-Foreclosure,” for multiple missed payments. I went on a re-payment plan with Option One, and was told NOT to miss another payment, or an automatic “date of Sale” would occur. I did make HUGE payments ($ 4200/mo) for another 5 months. Then , I received a “miss-leading” letter from them thinking that I was being given a “new” loan with a date for next payment which apparently would skip a month. As soon as I skipped a monthly payment, it went to sale immediately and Option One now has the only Bid on it. I am in Redemption period now, for another 6 weeks. My husband and I have been trying to get assistance from Washington Mutual for three months regarding our home loan with absolutely no help. Our faxes have been lost, we have been continually told to call back, and never once dealt with the same person. We are not behind so this advise did not apply to us, nor can we sell our home for our loan value. We were given no options. Obviously, our home’s value has dropped and will continue to drop as our interest rate increases. We are scared that we will have to let our house go into foreclosure, as the payments are simply to high to afford and the value is not there to refinance. Despite the fact that we have made all of our payments on time and have a steady income and have improved our credit score we can not seem to get any real information that is helpful and have been dealing with people who just seem to simply not care and feel are situation is just being avoided.

What is truly frustrating is we were initially told when we signed our refinance papers that our loan would be fixed for five years. We were lied to and believe documents were falsified. We were then told by Wamu that our loan does not qualify for the project Hope Plan created by president Bush, as we were told our loan is not a sub-prime loan. Every bit of information I read says our loan is indeed a sub-prime loan and freezing our interest rate could help save our home until the market improves, we really need loan modification help with Washington Mutual

Help modify my loan

After ten years with the same company, my husband lost his job (it was outsourced overseas) in December. We thought it wouldn’t take long for him to get something else so we started paying our mortgage and bills on our credit cards, assuming it was a temporary solution. I have a full time job but do not make enough to cover our expenses.
We now have acquired an extreme amount of debt. We called our Washington Mutual (WaMu) and followed the procedure that they advised, which was to fill out a packet explaining our financial situation and we were to include a letter of hardship. After 8 weeks of waiting, we were rejected on a technicality and had to start the process all over again. Its now been another 4 weeks and all they do is call and ask for money but refuse to help us until our packet has been approved. If this packet gets rejected we are once again, back to square one and will owe more to them with no assistance on their part.
I believe that their process is inherently set up for us to fail. We now just want out and we will never do business with Washington Mutual in any capacity in the future.
My husband is working through a temp agency that has been able to give him a decent amount of work. We are hoping that he will be able to secure a full time job in the near future. I am still at my job as well.
I have cashed in my (small) inheritance in order to try and pay off some debt but am wary about giving WaMu any of it. We could catch up with our mortgage now but in 3 months be exactly in the same position due to their failed customer service policies. We just don’t know what to do and they are harassing us for money but refuse to allow us to negotiate or be assigned a person until the packet is approved- which may or may not EVER happen. We tried to approach this in good faith. We want to make good on this and not go in to foreclosure but they are making it very difficult to work with them. Short Sale on Investment Property

This was an investment. Bought it in 2005,invested $ to rehab the home. By the time home was complete, market started to fall. Tried every which way to sell the property to stop foreclosure, this is a multi family home,even hard to keep the tenants. I owe $402,000,plus back payments of approx $30,000.Current FMV approx $350,000. Home was appraised 1 1/2 yrs ago at $480,000.This home is a MONEY PIT ! I WANT OUT ! Short Sale Assistance needed

We were consistent on paying the mortgage until February of 2008. We moved due to our job transfer and ill parent. We rented the property to tenants, this was managed by a rental management company, the tenants have not paid any rent since February 2008, this is when my husband lost his job. We need short sale help

March 17, 2008 I began the process of applying for the Loan Modification with Ocwen Mortgage Company.  I sent all the required documents and failed to include the listing agreement, initially.  After several conversations in which the Company stated that various documents had not been received, I responded immediately with faxes to cover the requirements, including the listing agreement. No action was ever taken to move the documents along to a decision-maker.  My last conversation with the Company’s liquidation department informed me that the property was scheduled for a Sheriff’s sale on June 12, 2008.
The clerk stated that my package was incomplete, since there was no listing agreement and there was no request to participate in the program and there was no hardship letter.  I was outraged and before the call was terminated, she stated that she found all of the documents, but since the information is now 90 days old, I would not be accepted. I pointed out that this process was started in a timely fashion and that no one ever gave me that excuse before.  She put me on hold and then returned.  She asked me what was the date on the listing agreement.  I read the dates on the agreement. The expiration of the agreement was May 31, 2008 with a month to month extension, thereafter. She stated that she could not read the wrting regarding the extension, so as far as she was concerned the Listing Agreement had expired.  My only option was to go to foreclosure and attempt to redeem the property after ten (10) days. I was and remain flabbergasted!
The Mortgage Company is still Ocwen is foreclosing.

We are trying to get current on our loan and try to mitigate our loan. We just received a arm change notice and our payment will go up to $3600.00 from $2256.00. We would like to get our loan back to the $2256.00 which we have been struggling to pay over the years. Our situation has changed. We have gotten a roommates in both our house and our place of business to help with the monthly payments. We are bringing $1200.00 stably each month with that. It appears the rate will be 6.52% in July when the arm resets-or is reaching it’s cap limit.
