I lost my job in December, but found another at a lesser pay. We were in a Chapter 13 trying to catch up, but I was just unable to make the payments. I have been trying to contact the attorney who handled the Ch 13 for us, but have had no response. At this point, I am past due on my BK payments, my secondary mortgage payments and my primary mortgage payments. Total due is probably around $4000. I recently spoke to the primary mortgage company and they told me that I would get a letter soon from their attorney-a notice of default. I am scared to death that I am going to lose my home. We have four small children and simply can’t afford to go through this. I am a good person who is trying very hard to do what is right. I am going to a job interview today in hopes that I can get a better paying job. Please help me so that I do not lose my home.

My husband and I purchased the home 8 yrs ago on a five yr. mortgage plan. We separated and i have tried to keep the house. We refinanced on a 3 yr. plan and then divorced this past year. I filed bankruptcy and reaffirmed the mortgage. The mortgage expired and my plan was to refinance in my name only. Timing has been an issue for me because my sister in law was living with me and she died of breast cancer a few weeks back. Trying to settle all of her stuff and take care of this has been an issue for me. And now time has gotten away from me. Because I have reaffirmed the loan, I will have to pay for the house anyway. I realize that the sale is tomorrow and I am not sure there is anything that can be done - but I really need your help. I fell behind due to being the primary caregiver of my sister-in-law during her illness. Her medications and care were very taxing. Her daughter is now living with me. I have access to money granted to me in our divorce from my husbands 401k. I want to keep my house and get my life back together. help stop foreclosure

The bankruptcy and foreclosure processes are closely tied to one another. If a customer files for bankruptcy while the loan is already in active foreclosure, then all foreclosure proceedings must be put on hold for a specific period of time as determined by the US Bankruptcy Court.
When a customer files for bankruptcy, and the mortgaged property is involved in foreclosure, the following events occur:
· The customer files bankruptcy
· The lender ceases foreclosure activities
The customer continues to be protected from foreclosure action until the following occurs:
The bankruptcy case is dismissed by the US Bankruptcy Court; or
The lender is granted a Relief from Stay; or
The chapter proceedings are terminated with a discharge or a denial of discharge by the court.
Although the foreclosure proceedings are ceased you will be placed on a repayment plan and if you miss even 1 payment you will be placed right back into foreclosure. We can get a repayment plan for you and keep a bankruptcy off of your record. Although repayment plans are an option we go a step further and push for a loan modification and also work to fix your adjustable rate. In bankruptcy that is not an option.
